Sitsongpeenongin manageri Rob Coxin palstalla:

Lainaa:
He has asked some senior figures in Thailand to negotiate terms with Por. Pramuk camp to clear the way for him to fight again. But he will never return to or fight under the P. Pramuk name again. He hopes to return to fight on April 17 at THAI FIGHT Pattaya.

Knowing this camp I have doubts the talks will be successful no matter who goes to talk with them. He has a legally binding contract with the camp under the sports authority of Thailand which allows P. Pramuk camp to stop him from fighting anywhere on the planet or ever again.

Buakaw might not be able to fight on April 17th Thai Fight event in Pattaya, Thailand

Kuva

Buakaw seemed ready to return to action after his recent split with Por. Pramuk Gym. He was expected to fight at the Thai Fight event in Pattaya, Thailand on April 17th under the name of his new gym Banchamek. According to the Bangkok Post, Buakaw might not be allowed to fight on the April 17th card in Pattaya because the Sports Authority of Thailand (SAT) has stated that Buakaw can’t fight until he registers his new camp with the proper authorities.

In addition to registering his new camp, Buakaw is expected to file a complaint against Por. Pramuk. The SAT will then investigate the claims that Buakaw was mistreated by the Por. Pramuk camp.

Buakaw still has roughly two weeks for this to be cleared up before the Thai Fight event. Hopefully everything gets squared away and he can fight on April 17th in Pattaya. Below is the exact article that appeared in the Bangkok Post.

“Buakaw can't fight

The Sports Authority of Thailand (SAT) said yesterday that Muay Thai superstar Buakaw Banchamek (formerly Buakaw Por Pramuk) can't take part in next month's Thai Fight unless he formally registers his new camp with the authorities.

Buakaw has severed ties with former camp Por Pramuk and has since set up his own camp.

He has also changed his fight name to Buakaw Banchamek following the split.

SAT deputy governor Sakol Wannapong said Buakaw cannot fight until he files a complaint with the SAT which will investigate if Buakaw was unfairly treated by Por Pramuk.

If his claim is proven true, then he will be allowed to fight, Sakol said.

The Thai Fight event will be held in Pattaya on April 17 and Sakol said Buakaw still has time to clear up his legal problems.”

Kannattaa lukea tuo Buakawin nyrkkeilykomissiolle tekemä sopimuksenpurkuhaaste.

Buakaw Government backed

It looks like Buakaw has gotten some government backing in his contest with his gym. The Thai government has stepped in to help negotiate the matters. Essentially Buakaw can buy himself out of his contract for 3 million baht, about $100,000. We’ll see how things pan out but things are looking up for our friend from Surin but I predict there will be more white skinned tourists in Isaan soon!

“To All Thai Muay Thai fans,

From the conflict between Buakaw, the champion of Thai Fight 2011, and his previous camp, Por Pramuk, and Thai Sport Authority. I, Mr. Intarat Yodbangtoey, had received the order from General Jongsak Panishakul, the Secretary of Priminister of Thai Government to help solve the issue between Buakaw and everyone involved. Buakaw is a boxer who represents Thailand as on…e of the best muay thai boxers. He is also a cultural symbol for our country as well. With many experienced years in Muay Thai which he showed to the world by obtaining a two time K-1 champion in Thai Fight in 2011. I would like to step in and conceal the problem in a fair manner to everyone involved.
I spoke to Buakaw personally, and the correct information that I received is that Buakaw had been treated unfairly in way of pay-cuts and an unfair contract that was not clearly explained.
With proof in the form of documents, I , in the name of The office of National Identity, assign this project with the lead, and ordered from Big General Yoodthasak Sasriprapa, believes that Por Pramuk camp, Thai Fight event personals and Thai Sport Authority all represent Thai culture and need to discuss to help solve this issue as soon as possible.
On April 18, 2012 at 19:30-21:30pm Thailand time, I, Second General Intarat Yodbangtoey, received the order from Head General Jongsak Panishakul to help solve the problem that occured between these personals. By doing this, I repeatedly and continually report my actions for acknowledgement to Mr. Sakol Wannapong, the second commander of Thai Sport Authority. These are the results from information which I received from Buakaw:
1. Por Pramuk Camp must agree to pay 3 million Bahts for profit that are owed to Buakaw.
2. The 3 million Bahts can be substituted by letting Buakaw free from contract with Por Pramuk Camp.
3. If neither above are agreed from Por Pramuk Camp, Buakaw would continue to use his sur name as Por Pramuk for entering the fight, but the profit would be 40:60. Buakaw would received 60%, and Por Pramuk 40% until the 3 millions bahts are paid within this split profit. The money that Por Pramuk owed to Buakaw would be taken as 20% from each fight both in and out of the country of Thailand. Until the debt is paid and the five year contract has ended, Buakaw will continue to use sur name as Por Pramuk and train at his own facility. But all this would not involve the profit from the promoter both from commercial, pictures, movies etc.
And, as fair judgement to both sides, I will discuss this issue with Mr. Pramuk Rotejanaton before the final decision to solve this problem is to be made.

Mr. Intarat Yodbangtoey.”

Additionally it looks like Buakaw has written a statement to the Boxing Commission about his ill treatment by Por Pramuk. Its worth looking at.

Subject: Termination of Contract
To: Board of Boxing Sport
March 26, 2012

I, Sombat Banchamek, would like to terminate my contract with Por Pramuk camp because of mistreated unfairly and it’s my right to asked or terminate this due to these reasons:

1. The leader and manager of Por Pramuk camp fails to provide appropriate care which led to damage to myself both physically and mentally. We understand boxing as a sport has a high chance of serious injury which could lead to handicap or death.

2. My health or safety unreasonably jeopardized as :

2.1 On December 2011, Mr. Pramuk Rotejanaton commanded in an unpleasant manner and made an order to eject Channel 9 V.I.P. crews members during my t.v.interview.

2.2 On December 14, 2011, four days before the final fight of Thai Fight event, Mr.Pramuk Rotejanaton spoke harsh with threatening words which made me concerned for my safety.

2.3 On January 2012, during the Titan’s Des Trois, France television show, Mr. Pramuk Rotejanaton interrupted the filming process with a phone call in which he was very unprofessional and used embarrassing words and demand to ejected the T.V. crews.

Mr.Teerapat Rotejanato and the manager of the camp failed to solve the problem and ignored the situataion. These two incidents above led to my decision of move out from camp.

3. The profit after each fight is lesser than 50:50 and they never pay on time, which is against the laws and regulation of boxing. As these incidents:

3.1 Still have not received 400,000 Thai Bahts from my professional boxing career while Mr.Pramuk Rotejanaton served as leader and manager of the camp.

3.2 The fight purse after K-1 tournament event was 10,000,000 yen (Japan Currency) , which was approximately 3,630,000 baths ( Thai Currency), I only received 1,000,000 Bahts from the leader and manager of the camp.

3.3 My winnings from my Runner-Up finish in K-1 competition in 2005 amounted to ¥2,500,000, or ?832,500. From that ?832,500 payout, I only received ?15,000.

3.4 My winnings from my First Place finish in K-1 competition in 2006 amounted to ¥20,000,000, or ?5,648,000. From that?5,648,000 payout, I was only awarded ?2,000,000 which was immediately loaned out to Rotejanaton’s family. To this day, I have not seen any of the money from that fight.

3.5 Mr. Teerapat Rotejanaton, the manager of the camp, has borrowed?400,000 and has not returned any of it.

3.6 My sponsorship with the Singha Corporation was worth a total of ?3,000,000. To date, I have only received ?440,000 of this money from my manager.

My agreement with my manager was to split the revenues from all of my commercials, television shows, modeling, and sponsorships 50:50 with management. Instead, management has subtracted costs they attribute to “living expenses” from total revenues before paying me half of the remainder.

4. Mr. Teerapat Rotejanaton, recent manager of Por Pramuk camp, and Mr. Pramuk Rotejanaton the previous manager, have ruined my reputation and good name with false accusations and slander given in numerous interviews with the media.
Of the above, the duties of the chief outlets, against the rules of Boxing Act, BE 2542 Section 1 of Article 5: The duties of the chief outlets are as follows:
Article 2: Safety and the welfare of boxers, trainers and those involved in managing the camp.
Article 3:To be fair to the fighter and not under any contract or agreement in the manner of exploitation or fraud.
And (6) The money shall be paid to the boxer who wins any of the competitions as laws allow.

To accept property or benefits for themselves, through illegitimate means and the threats by the manager of Por Pramuk camp, the Boxing Council Regulation on jurisdiction and the jurisdiction of the 2544 outlets in 14 states under the outlets before the end of the request may be made under subsection (2) breach of contract per head of outlets or manager of the camp failed to take care of the boxer which led the boxer to feeling unsafe and leaving the camp, and (3) The negligence of the manager of the Por Pramuk camp does not protect the rights of their boxers and allows theft of the prize. As a result, the profession of boxing has been compromised. If the decision made by the Registrar’s request, outlets of the parties under the contract are terminated. In addition to the regulations, in this section are specified in Article 18 (5) the party that has been damaged has the right to terminate the agreement immediately.

Yours Truly,

Name: ………………….

Buakaw and Thai Fight Being Sued for 100 Million Baht by Por Pramuk Camp

It seemed inevitable that sooner or later the trigger would be pulled on the impending lawsuit between Por Pramuk, former Por Pramuk fighter, Buakaw, and the Thai Fight organization. Thai Fight ends up completely stuck in the middle between the two parties after they allowed Buakaw to fight on the April 17th event without consent from Buakaw's former management camp and doing so without paying them. There was talk of government involvement, including an ultimatum, but apparently the Por Pramuk camp has decided to move forward with a lawsuit.

The Bangkok Post has a story up detailing the suit, which has Por Pramuk suing for 100 million baht, or approximately $3.24 million USD. Por Pramuk's lawyer is motioning for Buakaw to settle this matter outside of court. The SAT is asking Buakaw and Por Pramuk to attend a meeting on May 10th to attempt to settle this as well, but if nothing is settled shortly a preliminary hearing is set for July 16th.

It seems like it will be quite a while before we get to see Buakaw fight again, sadly.

Buakaw on palannut munkkiudesta ja taas väännetään oikeudessa. Thainyrkkeily-skenen vihatuin mies Mr. Pramuk Rojanathan ei laske Buakawia menemään, eikä suostu kohtuullisiin palkkiosiivuihin.

Lainaa:
The problems between Buakaw & Por Pramuk camp have not been completely resolved. Both parties do not fully agree with the terms of a new contract between them & thus did not sign it today. Mr. Pramuk Rojanathan, the owner of Por Pramuk camp, refused to sign as he is unhappy over the request to drop his lawsuit against Buakaw's sports science trainer, Mr. Teerawat Yioyim. In addition, Major General Intharat Yodbangtoey, the mediator in this dispute, said that he wants to give both parties more time to examine the clauses in the new contract as there are details need to be further clarified & worked out, & so they will all meet to discuss again on 31 May 2012. The reporter tried to ask Mr. Pramuk & his son Mr. Teeraphat about his objection to signing the new contract, but they refused to speak to the press & left immediately." (Credit for the translation Banchamek Gym)

Addtion: Before the above issue was suddenly unclear again. There was a mutual agreement on following terms:

1. In case of a fight purse, the share would be 60 % Sombat Banchamek, 40 % Por Pramuk.
2. Sombat Banchamek has to continue to fight under the name "Buakaw Por. Pramuk".
3. If Sombat Banchamek is engaged in any other work, outside the ring( Advertisment, Talkshows etc.) the share would be 75% Sombat Banchamek, 25 % Por. Pramuk.
4. Outside the ring activities (paid work) would have to be agreed on, by both sides.
5. This contract would be valid until november 2018, from the date of signature.
6. Por Pramuk would drop the charges against Sombat Banchamek in court.
7. Sombat Banchamek trains on his own in his Gym in Surin Province.

Please note that, there are still some other smaller issues in the new contract which could not be agreed on. ( Report Timo Ruge)

To be continued....

31 May 2012. Buakaw announced his retirement from fighting after he was unable to reach an agreement with Mr. Pramuk Rojanathan of Por Pramuk camp over the new contract.

Kuva

This afternoon, Buakaw met with Mr. Pramuk at the Sports Authority of Thailand (SAT) for another round of negotiations over his new contract after they failed to reach a conclusion at the previous meeting [on 22 May 2012]. Also present at today's meeting were the Deputy Governor of SAT & the President of the Professional Boxing Association of Thailand.

Before the meeting began, Mr. Dej Jaikla, the Director-General of the Board of Boxing Sport, asked the media to leave the room. However, Mr. Pramuk asked that the media be allowed to stay.

Por Pramuk camp's lawyer said that the camp was willing to drop their lawsuit against Mr. Teerawat Yioyim, Buakaw's sports science trainer, provided that Buakaw accepted the new contract. The new contract specifies that [until 5 November 2018] income from fights will be divided 60:40 (60% to Buakaw, 40% to the camp), & all other income from activities such as (but not limited to) public appearances, advertising & sponsorship will be divided 75:25 (75% to Buakaw, 25% to the camp).**

However, Buakaw's lawyer said that Buakaw should be entitled to 100% of his income from activities outside of the ring, & should not be made to share it with the camp. This is because Buakaw is already 30 years old & has at most a few years left in his career as a boxer.

When an agreement could not be reached, the camp's lawyer said that the camp would be happy to sell Buakaw off to another camp that is interested in buying him. This had been proposed by Major General Intharat Yodbangtoey (the mediator in the dispute between Buakaw & Por Pramuk camp) at the previous meeting on 22 May 2012.

Buakaw then said that since both parties could not agree, & that the outstanding issue now lies with him alone, all problems should come to an end if he retires. His family & his first muaythai teacher had never asked for money, & he has already repaid their kindness in full. Therefore, he would like to retire from boxing from now on. He will not fight again, & will not try to register [as a boxer with the Board of Boxing Sport] again under a different name. On hearing this, Mr. Pramuk & his son Mr. Teeraphat (Au) burst into applause lasting many minutes.

The Deputy Governor of the SAT said that it is most regrettable that an agreement could not be reached, & that things had to end this way. He said that it is bad for Thailand's image that Mr. Pramuk & Mr. Teeraphat had clapped happily when Buakaw said that he would retire & not continue to fight & achieve success for the nation.

Mr. Pramuk retorted that he had clapped for joy not because Buakaw will retire but because all the problems he has had with Buakaw since March will come to an end.

Mr. Pramuk later said that he regrets that Buakaw will not continue to bring fame to Thailand, & claimed that the dispute had to end this way because of a 'third party'. He thinks that this would not have happened if not for issues related to money, & that in the past, the careers of famous boxers have ended because of such problems. In any case, he is relieved that things have come to an end.

Buakaw said that it is regrettable that he has to retire even though he is still able to fight. However, he wanted to end this dispute once & for all. He had thought about it [the decision to retire] beforehand, & confirmed once again that there was no 'third party' behind his decision.

Buakaw also said that he has brought fame to the country all along, & it is better for him to retire when he is at the top, rather than to retire when his career is fading away.

When everything has been settled, Buakaw will not leave the muaythai scene totally, but return to his home in Surin province to train a new generation in muaythai at his Banchamek Gym. Many children have applied to join his gym, including the children of foreigners. When asked if he would consider becoming a promoter, he said that it is too early to think about it now.

Buakaw would like to apologise to all of his fans for his decision to retire, & assures everyone that this is not the last that they have seen of him. He would like to thank everyone & the whole country for their support & encouragement. In addition, he would like young fighters to view his case as an example, & hopes that this will be the last time such a case ever happens in the muaythai scene.

Buakaw vapaaotteluun?

Ottelut on oteltu, harva ulkomainen promoottori haluaa katkaista välit SAT:n kanssa, jolla on tarvittaessa kieltovaltaa ulkomaille ottelemaan lähteviin thaikkuihin.

Lainaa:
8 June 2012. After shocking the muaythai world by announcing his decision to retire, Buakaw submitted a letter to the Sports Authority of Thailand's Board of Boxing Sport requesting that he be officially released from being a muaythai fighter of Thailand belonging to Por Pramuk camp.

Recently, there has been talk of Buakaw switching over to mixed martial arts (MMA), & his Banchamek Gym facebook page has been releasing photos of him training. The Thai Rath news team talked to Mr. Dej Jaikla, the Director-General of the Board of Boxing Sport, who said that Buakaw is free to engage in this sport because MMA is not under the control of the Boxing Act (1999). Mr. Dej said that the Boxing Act covers only muaythai & Western-style boxing fights, & muaythai demonstrations & other styles like K-1 or other martial arts are not under the control of this Act.

In any case, there are still 5 years [in actual fact 6.5 years, until November 2018] to go before Buakaw's existing contract with Por Pramuk camp expires. This means that if Buakaw receives any income for competing in any sport or doing any activity e.g. public appearances, acting in a show, or advertising, Por Pramuk camp could sue him for their share of his income based on the terms of the existing contract. This would be beyond the control of the Board of Boxing Sport.

MMA is a sport that integrates various types of martial arts such as muaythai, Western-style boxing, judo, wrestling, karate, sambo & jiujitsu. It is a popular fight sport around the world, especially in the U.S., with competitions such as the Ultimate Fighting Championship (UFC). Many Thai boxers have crossed over to MMA, like Rambaa Somdet M-16 & Yodsanan Sityodthong.
